Grit and Valor – 1949: Demo Livestreaming Competition Terms and Conditions

The competition

1.1. The promoter and organiser of this competition is Aonic AB (Publ),  a public limited liability company incorporated in Sweden with its registered office at Västra Trädgårdsgatan 15 111 53 Stockholm, Sweden, and registration number 559335-7527 ("Megabit").

1.2. These terms and conditions govern the legal relationship between Megabit and you (referred to in these terms and conditions as “you” or “yours”) in relation to the competition.

1.3. Please read these terms and conditions carefully, and in particular clause 8.1 regarding how Megabit will handle your personal information in relation to the competition. If you have any questions about the use of your personal information processed by Megabit for the purposes of this competition or wish to exercise your rights in relation to your data, please contact dataprotection@megabit-publishing.com.

1.4. The title of the competition is "Grit and Valor – 1949: Demo Livestreaming Competition".

1.5. For the purposes of these terms and conditions, "Game" has the meaning ‘the Demo version of Grit and Valor – 1949’.

1.7. This competition is in no way sponsored, endorsed, administered by or associated with Twitch, SullyGnome or Amazon.

How to participate

2.1. No purchase is necessary to submit an Entry.

2.2. By submitting an Entry, you are agreeing to be bound by these terms and conditions.

2.3. You may only submit one Entry to this competition.

2.4. In order to enter this competition, you must complete each of the following steps prior to the end of the Competition Period ("Entry"):

       2.4.1 have an account with Twitch.tv ("Twitch");

       2.4.2. stream the game for at least 30 minutes under the Grit & Valor: 1949 category

       2.4.3. complete and submit the sign-up form at https://mailchi.mp/megabit-publishing/grit-and-valor-streaming-competition ("Sign-Up Form").

2.5. Any Entry will be void and excluded from this competition if:

      2.5.1. you do not comply with these terms and conditions;

      2.5.2. you provide incorrect, incomplete or misleading information in the Sign-Up Form; or

      2.5.3 you are considered in the sole discretion of Megabit to be part of an attempt to, cheat, manipulate or unfairly influence the outcome of this competition.

2.6. Megabit, in its sole discretion, may exclude any period of time livestreaming of the Game where (i) it does not constitute Active Gameplay, (ii) it is performed on your behalf by someone else or by a computer, software or non-human; or (iii) it is considered, in the sole discretion of Megabit, to be part of an attempt to cheat, manipulate or unfairly influence the outcome of this competition.

2.7. For the purpose of this Competition, "Active Gameplay" has the meaning:

      2.7.1. other than for occasional brief breaks, broadcasting/streaming of gameplay of the Game in real-time with the presence of the live status indicator and with occasional engagement in real-time with audiences or viewers; and

     2.7.2. inclusion of the full name of the Game (Grit and Valor – 1949) in the stream title and/or in tags.

     2.7.3. Megabit's decision on your eligibility for Entry or if a session (or part of such session) of livestreaming of the Game is excluded or not are final and Megabit is not obliged to provide an explanation or justification.

Entry Period

The competition will start at 00:01 (British Summer Time) on 22 July 2024 and close at 23:59 (British Summer Time) on 25 August 2024 inclusive ("Competition Period").

Selection of the winner

4.1.There shall be 5 winners in total.

4.2. The winners of the competition will be the 5 entrants who, at the end of the Competition Period, have the 5 highest overall amounts of time of livestreamed Active Gameplay of the Game on Twitch during the Competition Period according to the website www.SullyGnome.com.

Prize

5.1. The prizes for the winners is an Amazon e-Gift Card and will be awarded as follows:

     - 1st: £250, €250, $250, $345 (Canadian Dollars), depending on the location of the winner.

     - 2nd: £100, €100, $100, $140 (Canadian Dollars), depending on the location of the winner.

     - 3rd: £75, €75, $75, $100 (Canadian Dollars), depending on the location of the winner.

     - 4th: £50, €50, $50, $60 (Canadian Dollars), depending on the location of the winner.

     - 5th: £25, €25, $25, $35 (Canadian Dollars), depending on the location of the winner.

5.2. There are no alternative prizes.

5.3. The prize is for the named winner only and cannot be given or transferred to any other person. The prize may not be claimed by a third party on the winner's behalf.

5.4. Megabit is not responsible for any customs charges or import taxes arising from shipping of the prize, which will be payable by each winner.

Restrictions and requirements

6.1. The competition is open to any legal resident in the United Kingdom, the European Union, the United States of America and Canada aged 18 years old or older, except to:

      6.1.1. employees of Megabit, its holding or subsidiary companies;

      6.1.2. employees of agents or suppliers of Megabit, its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

      6.1.3. members of the immediate families or households of clauses 6.1.1 and 6.1.2 above.

      6.1.4. Megabit may ask for proof of age, residence or eligibility. Delay or failure to provide the evidence to Megabit’s reasonable satisfaction may result in an entry being void or a prize being forfeited.

Notification of the results and receipt of the prize

7.1. Megabit shall notify each winner by sending the prize by email to a winner’s email address provided in the Sign-Up Form on or before 24 September 2024.

7.2. Megabit shall publish or make available information that indicates that a valid award took place by announcing the winners of the competition in a post published from one of Megabit’s social media accounts and/or on its website https://megabit-publishing.com/ on or before 24 September 2024.

7.3. Megabit does not accept any responsibility or liability if you are not able to receive the prize or if you provide the incorrect email address in the Sign-Up Form.

Personal information

8.1. As part of signing up to participate in this competition, you are required to submit the following personal information to Megabit via the Sign-Up Form:

      8.1.1. your name;

      8.1.2. your Twitch username; and

      8.1.3. your email address.

8.2. By entering this competition, you agree and consent to any personal information submitted by you in the Sign-up Form and any other personal information provided by you to Megabit to be used by Megabit to process your Entry to operate this competition and send prizes to winners.

8.3. Megabit may disclose your personal information to other members of Megabit’s corporate group in order to carry out this processing. In such event, Megabit’s subsidiary or affiliate companies are subject to this Policy when they use your personal information. Your personal information will not be sold to any third parties.

8.4. Personal information provided by you to Megabit for the purposes detailed in clause 8.1 will be stored for up to 60 days after the end of the Competition Period or deleted manually within 30 days from receipt of your deletion request (whichever is earlier).

General

9.1. While nothing in these terms and conditions will limit Megabit’s liability for death or personal injury caused by Megabit’s negligence or for fraud, Megabit will not be legally responsible to entrants or winners for any losses that were not foreseeable to Megabit or to you at the time of entry to this promotion or which are caused by a third party. For the avoidance of doubt, this includes incorrect or missing data provided by SullyGnome or displayed on its website www.SullyGnome.com.

9.2. The laws of England and Wales apply to these terms and conditions, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.

9.3. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
